NEWRA ZLC Addressed Two Proposals

Table, by Jen Royle, LLC, has appealed to the Board of Appeal to remove the proviso in the Board’s May 28, 2012 decision allowing a restaurant with takeout limited to “this petitioner only”.

The request was presented at the North End Waterfront/Resident’s Association Zoning and Licensing Committee meeting on Tuesday, September 28 at the Mariners House, 11 North Street.

The location is 396 Hanover Street that was most recently operated as a café known as My Cousin’s Place.

The property is located in a Multifamily Residential/Local Services Subdistrict where a takeout restaurant with total gross floor area not exceeding 1,000 square feet is conditional use in the basement and first story.

Applicant proposes to continue to operate the space as a restaurant with take out, serving sandwiches, coffee and gelato.

The Committee will report to the Full Board on Tuesday, October 2.

Top Control Construction, Inc., has appealed to the Board of Appeal on behalf of 5 Garden Court Condominiums to enlarge the living space for Unit 1 by excavating the existing basement to the garden level. The property is located in a Multifamily Residential Subdistrict.

The zoning violation identified by the Inspectional Service Department (ISD) is Floor Area Ratio Excessive in the North End District zoning code is 3.0. Existing FAR (presumably pre-code) is 4.0.

The proposal will add 627 square feet of living space, resulting in an FAR of 4.7. No units are being added to the existing building.

The Committee will present a report to the full NEWRA Board.
